My Reward Cards Application Terms and Conditions for End Users

Welcome to My Reward Cards! These Application Terms and Conditions (the “Terms”) govern your use of the My Reward Cards mobile application (the “App”) and constitute a legally binding agreement between you (the “User” or “you”) and Safe Pass Services (“we,” “us,” or “Safe Pass Services”). By accessing or using the App, you agree to comply with these Terms. If you do not agree with these Terms, please refrain from using the App.

1. Eligibility:

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are 13 years of age or older.

2. Account Registration:

To access certain features and services provided by the App, you may be required to create an account. You agree to provide accurate, complete, and up-to-date information during the registration process. It is your responsibility to maintain the confidentiality of your account credentials, and you are solely responsible for all activities that occur under your account.

3. Personal Information:

The collection and use of your personal information are subject to our Privacy Statement. By using the App, you consent to the collection, processing, and use of your personal information as described in the Privacy Statement.

4. User Content:

By submitting or uploading content to the App, including but not limited to pictures, text, or other materials (“User Content”), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content worldwide in connection with the App’s services. You represent and warrant that you have the necessary rights to grant us this license to User Content.

5. Intellectual Property:

All trademarks, service marks, trade names, logos, and other intellectual property rights related to the App are the property of Safe Pass Services or our licensors. You may not use, copy, reproduce, modify, distribute, or display any of our intellectual property without our prior written consent.

6. Prohibited Activities:

When using the App, you agree not to:

a. Violate any applicable laws or regulations; b. Infringe upon the rights of others, including intellectual property rights; c. Engage in unauthorized access to the App or any part of its infrastructure; d. Transmit or distribute viruses, malware, or other harmful computer code; e. Attempt to interfere with the proper functioning of the App or disrupt its services; f. Use the App for any fraudulent, deceptive, or malicious purposes; g. Harass, stalk, or harm other users of the App; or h. Engage in any activity that violates these Terms or our Privacy Statement.

7. Rewards, Tokens, and M.R.C.:

The App provides a reward system for participating merchants, where you can earn points, tokens, and M.R.C. These rewards may have specific terms and conditions set by the merchants, and some points may have an expiration date. Merchants’ advertisements, including promotions, will be subject to your preferences as outlined in the Privacy Statement.

8. Geolocation:

When processing transactions with tokens, points redemption, and M.R.C. payments, we may collect and use geolocation data for transaction verification purposes. For more information, please refer to our Privacy Statement.

9. Modification and Termination:

We reserve the right to modify, suspend, or terminate the App or any part of its services at any time, with or without notice. We may also update these Terms from time to time, and it is your responsibility to review them periodically. Continued use of the App after any changes to the Terms constitutes acceptance of those changes.

10. Disclaimer of Warranty:

THE APP AND ITS SERVICES ARE PROVIDED ON AN “AS-IS” BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION, MATERIALS, OR CONTENT AVAILABLE THROUGH THE APP.

11. Limitation of Liability:

IN NO EVENT SHALL SAFE PASS SERVICES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE APP OR ITS SERVICES.

12. Governing Law and Dispute Resolution:

These Terms shall be governed by and construed in accordance with the laws of your country. Any disputes arising out of or related to these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules , and the arbitration shall take place in your country. The arbitrator’s award shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

13. Severability:

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall not be affected and shall continue in full force and effect.

14. Entire Agreement:

These Terms, together with our Privacy Statement, constitute the entire agreement between you and Safe Pass Services regarding your use of the App and supersede all prior or contemporaneous communications and proposals.
